Terms of Service & End User License Agreement

1. Acceptance of Terms

By accessing or using the Memoir Builder application (web, mobile, or desktop), you agree to be bound by these Terms of Service and our App Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Memoir Builder is an application operated by Worldwide Waypoints, LLC, a Florida limited liability company, that lets you organize, write, and export your life story. This Agreement grants you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

3. Age Requirement

You must be 18 or older to use the Service. By creating an account, you represent that you meet this requirement — we don't collect a birthdate or otherwise verify age.

4. Accounts

You may create an account with an email and password, or by signing in with Google or Apple. You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Your Content

"Your Content" means the chapters, cards, text, photos, and documents you create, write, or upload while using the Service. You retain full ownership of Your Content. We don't claim any ownership over it.

By uploading or creating Your Content, you grant Worldwide Waypoints, LLC a limited, non-exclusive license to store, process, and display Your Content back to you — for example, to render your board, generate a PDF export, or power the AI assistant — solely for the purpose of operating the Service for you. We don't use Your Content to train AI models, sell it, or share it with anyone else, except as described under "AI assistant" below.

AI assistant. The AI assistant is available only to signed-in accounts. When you send it a message, we send that message, along with the structure of the board you're working on — the titles, descriptions, and statuses of your columns, chapters, and cards, and the file names of items attached to cards — to a third-party AI provider, which we reach through OpenRouter, a service that routes the request to the underlying AI model provider. We do not send the contents of your uploaded files or of documents you write, and we do not send your name, email address, or other account details. Because titles and descriptions can contain names and personal details, please leave out anything you don't want processed this way. The provider processes what we send in order to generate a response and is subject to its own terms and privacy practices. The assistant can only suggest changes: nothing on your board changes unless you approve it. Your conversations with the assistant are stored with the board they belong to.

You're responsible for Your Content, including having the rights to any photos or documents you upload. You may delete Your Content or your entire account at any time — see our Delete My Data Policy.

6. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by Worldwide Waypoints, LLC. We assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

7. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

8. Disclaimers & Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including warranties of performance, compatibility, or error-free operation. To the maximum extent permitted by law, our liability to you for any claim arising from your use of the Service is limited to the amount you paid us, if any, or $100 USD, whichever is greater.

9. Dispute Resolution

If a dispute arises, you agree to first contact us and attempt to resolve it informally before pursuing formal legal action.

10. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law provisions.

11. Changes to These Terms

We may update these Terms from time to time. For material changes, we'll provide at least 30 days' notice before they take effect. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. The effective date and version number at the top of this page reflect the most recent revision.
